1. Acceptance of these Terms
These Terms & Conditions (the "Terms") govern your access to and use of the website at midwestmindandbodyhealthcare.com (the "Site") and any healthcare services you receive from Midwest Mind & Body Healthcare (the "Practice," "we," "us"). By using the Site, booking an appointment, or receiving care from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services.
These Terms form a binding legal agreement. Before you become a patient, we will also ask you to sign additional intake and consent documents (informed consent for treatment, HIPAA acknowledgment, financial responsibility, and, where applicable, a controlled-substance agreement). Those documents govern your clinical care and, where they conflict with these Terms, the clinical documents control with respect to the care provided.
2. Who We Are
Midwest Mind & Body Healthcare is a Nebraska healthcare practice owned and operated by Kimberly Wohlwend, MSN, APRN, a dual ANCC board-certified nurse practitioner (Family Nurse Practitioner and Psychiatric-Mental Health Nurse Practitioner) licensed in the state(s) where she provides care. Our principal office is 131 N Washington Street, Suite A, Papillion, NE 68046.
No financial relationship with referral partners. We refer patients to independent therapy practices (see our Partnerships page) based solely on clinical judgment and patient fit. We do not pay, receive, or share any remuneration for referrals. This is consistent with the federal Anti-Kickback Statute (42 U.S.C. § 1320a-7b), the federal Stark Law (42 U.S.C. § 1395nn), and applicable state self-referral laws.

4. Eligibility & Accurate Information
- You must be at least 18 years old to use the Site and to receive care from us. We do not treat patients under 18.
- You must be physically located in a state where we are licensed at the time of each visit, consistent with the rules of that state's medical and nursing boards.
- You must provide truthful, accurate, and complete information at intake and thereafter. Clinical decisions depend on the information you give us; withholding or misrepresenting information may cause harm and may result in termination of our clinician-patient relationship.
- You must promptly disclose if you are pregnant, trying to conceive, or breastfeeding. Many of the medications we prescribe (including GLP-1s, estrogen and testosterone therapies, tretinoin, and others) have pregnancy warnings or are contraindicated, and this disclosure is critical to safe care.
- You must tell us about all other medications, supplements, and significant medical or psychiatric history, and you must update us when these change.
- If you are acting as a personal representative or legal guardian for another adult, you must have legal authority to do so and must document it as we request.
5. State Licensure & Scope of Services
We provide healthcare only where we are licensed and where the applicable state's laws permit us to practice by telehealth. The chart below summarizes current availability. This chart may change; the Services pages and each specific service page are the authoritative source at any given time.

Some medications are restricted by state law or by federal law, and we cannot prescribe them in every state we otherwise serve. If we determine we cannot treat a condition within the scope of our license or scope of practice, we will tell you and, where possible, help you find an appropriate alternative.
6. Informed Consent to Telehealth
If you receive care by telehealth, you acknowledge and agree to the following as part of your informed consent. You will be asked to sign a more detailed informed-consent form at intake.
- What telehealth is. Telehealth means the delivery of healthcare services using electronic communication, information technology, or other means between the clinician and the patient who are not in the same physical location. Telehealth visits may include real-time video conferencing, real-time audio-only conversations where permitted, and asynchronous messaging or questionnaire review.
- Benefits. Telehealth can improve access, reduce travel, and make care more convenient. It allows you to receive care from your home.
- Limitations. Some conditions cannot be fully evaluated or treated by telehealth; in those cases we will refer you for in-person care. Technology failures can interrupt a visit. If a serious adverse event occurs during a telehealth visit, we may direct you to seek in-person care or emergency services.
- Privacy. We use video and portal technologies that are designed to comply with HIPAA. You are responsible for finding a private location on your end. Please do not attend a visit while driving or while engaged in any other activity that prevents you from focusing on the visit safely.
- Recording. We do not record visits. We ask that you not record visits either; if you believe you have a medical or accessibility-related reason to record, please raise it with us in advance so we can accommodate the reason appropriately.
- Location. You must be physically located in a state where your clinician is licensed at the time of the visit, and you must tell us if your location changes.
- Withdrawing consent. You may withdraw consent to telehealth at any time, without prejudice to any care you have already received. You may also request an in-person visit if one is available.
- State-specific consent forms. Several states require telehealth-specific informed-consent elements beyond what is described here. Where state law requires a particular form or additional disclosure, you will be asked to sign the state-specific form at intake.
7. Asynchronous vs. Live Visits
Our mental-health care and new-patient weight-loss and hormone-therapy visits are generally conducted live (in person or by video). Certain online prescription services (such as topical tretinoin, oral minoxidil, vaginal estrogen, estriol facial cream, eye cream, and arousal cream) may be offered as asynchronous services, meaning the clinician reviews your intake questionnaire, photographs (where relevant), and medical history without a real-time visit. Asynchronous care is offered only where state law permits and only for conditions and medications where it is clinically appropriate. You may be asked to schedule a live visit instead if we determine one is needed.
8. Prescribing & Controlled Substances
Any prescription decision is a clinical judgment. Completing an intake or paying a fee does not guarantee that a prescription will be written. We will not prescribe anything we do not believe is clinically appropriate for you.
8.1 Controlled Substances (Ryan Haight Act)
Federal law, principally the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 and DEA implementing regulations, places strict limits on the prescribing of controlled substances through telemedicine. As of the effective date above, where we prescribe controlled substances (for example, certain ADHD medications), we follow the applicable federal telemedicine flexibilities and the requirements of the patient's state. If federal law requires an in-person evaluation before a controlled substance can be prescribed, we will schedule one. We reserve the right to decline any controlled-substance request and to require drug screening, prescription-monitoring-program review, and periodic in-person visits as conditions of ongoing prescriptions.
8.2 Early Refills, Lost or Stolen Prescriptions
Controlled-substance prescriptions cannot be refilled early or replaced if lost or stolen except under narrow circumstances permitted by federal and state law. We are required by law to verify claims of lost or stolen medication and may require a police report.
8.3 Off-Label Prescribing
Several medications we prescribe are used off-label, meaning the FDA has not approved the medication for the specific use we recommend, even though the medication itself is FDA-approved for other indications. Off-label prescribing is legal and is often the standard of care where peer-reviewed evidence supports the use. Examples in our practice include:
- Low-dose oral minoxidil (FDA-approved for hypertension) used for androgenetic hair loss.
- Testosterone (FDA-approved for men with hypogonadism) used for women with symptomatic low testosterone.
- GLP-1 receptor agonists when prescribed for indications or at doses other than those specifically listed on the FDA label.
- Certain psychiatric medications used for related conditions outside the primary FDA-approved indication.
We will tell you when a prescription is off-label and will explain the evidence, risks, and alternatives so you can make an informed decision.
9. Compounded Medications
Some of the medications we prescribe, for example estriol facial cream, prescription eye cream, and female arousal cream, are compounded, meaning they are prepared by a licensed compounding pharmacy to our specifications rather than manufactured by a large drug maker. Compounded medications are not FDA-approved, have not undergone FDA review of safety and efficacy for specific indications, and may not be interchangeable with FDA-approved products. Where an FDA-approved alternative is clinically appropriate, we will offer it.
503A pharmacies. All compounded medications we prescribe are dispensed by state-licensed 503A compounding pharmacies pursuant to a patient-specific prescription, consistent with Section 503A of the Federal Food, Drug, and Cosmetic Act. We do not prescribe from 503B outsourcing facilities, and we do not advertise or suggest that compounded medications are safer or more effective than commercially available FDA-approved alternatives.
Compounded medications are made to order and are generally not returnable once dispensed. Refunds for compounded medications are handled by the pharmacy, not by us.
10. Mental Health Services (Nebraska Only)
Mental-health services are currently licensed in Nebraska only. During a mental-health visit, we may discuss hormones, weight, sleep, or metabolic health because those affect mental health, but any medical treatment, prescriptions, or dose changes for weight loss or hormone therapy must be handled through a separate self-pay medical visit. Insurance does not permit those services to be billed under mental-health coverage.
If you are in a mental-health crisis, call or text 988, call 911, or go to the nearest emergency department. Our services are not designed for crisis care.
11. Insurance, Payment & Fees
- Insurance (mental health only). We are in-network for mental-health services with Aetna, Blue Cross Blue Shield, UnitedHealthcare (including UMR), Midlands Choice, and Nebraska Total Care (Medicaid). Coverage and patient responsibility are determined by your plan, not by us. You are responsible for any copay, coinsurance, deductible, or non-covered amount.
- Self-pay. Medical weight loss, hormone therapy, and online prescription services are self-pay. Current pricing is posted on the corresponding service pages. Pricing may change; the price displayed at the time you book controls for that visit.
- Good-faith estimates. If you are uninsured or electing not to use insurance, we will provide a good-faith estimate of expected charges as required by the federal No Surprises Act.
- Non-clinical fees. Administrative services (for example, form completion, letter writing, records transfer beyond what is required by law) may carry separate fees, which we will disclose in advance.
- Medications. The cost of medications is billed to you by the pharmacy, not by us. Cost varies by pharmacy, insurance, and coupon programs.
12. Cancellation & No-Show Policy
We ask for at least 24 hours' notice if you need to cancel or reschedule. Appointments cancelled with less than 24 hours' notice, or missed without notice, may be subject to a cancellation or no-show fee, which we will disclose at the time of booking and which will not exceed the self-pay visit fee. Repeated no-shows may result in termination of the clinician-patient relationship. See our Refund Policy for additional detail.
Medicaid beneficiaries. Consistent with federal Medicaid rules and the Nebraska Total Care provider manual, we do not charge Medicaid beneficiaries for cancelled or missed appointments. This carve-out is automatic; you do not need to request it.
13. Website Content & Intellectual Property
All content on the Site, including text, graphics, logos, photographs, and the overall design, is owned by or licensed to Midwest Mind & Body Healthcare and is protected by U.S. and international copyright and trademark laws. You may view and print content for your personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, or create derivative works without our prior written consent. "Midwest Mind & Body Healthcare" and our logo are trademarks of the Practice.
14. Patient Reviews & Submissions
We display patient reviews on the Site to help prospective patients understand what care with us looks like. Our review practices are designed to comply with the Federal Trade Commission's rule on the use of consumer reviews and testimonials (16 C.F.R. Part 465):
- Source. Reviews are collected through public review platforms (such as Google). We do not fabricate reviews, and we do not display reviews written by employees, owners, or their family members.
- Editing. Reviews are displayed verbatim where feasible. Where we edit, we edit only for clarity, grammar, or to remove identifying information (such as a reviewer's last name or a child's name). We do not edit reviews to alter their substance or meaning.
- No compensation. We do not offer money, discounts, gifts, or any other incentive in exchange for reviews, and we do not condition care or responses on whether you leave a review.
- Negative reviews. We do not suppress, bury, or request removal of negative reviews, except where a review contains protected health information or violates the review platform's own policies.
- Selection. Where we display a selection of reviews rather than all available reviews, the selection is chosen to be representative and is not curated to exclude negative feedback.
If you submit a review, comment, testimonial, or other content to us, you represent that it is truthful and that you own or have the right to share it, and you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute it in connection with the Practice's services. You can ask us to remove a review you submitted at any time.
15. Third-Party Links & Services
The Site may link to third-party websites (such as our online booking portal at Tebra, the 988 Lifeline, or medical resources). We do not control those sites and are not responsible for their content, privacy practices, or availability. Linking is not an endorsement.
16. Disclaimers
The content of the Site is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified clinician with any questions you may have about a medical or mental-health condition. Never disregard professional medical advice or delay seeking it because of something you read on this Site.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
17. Limitation of Liability
NOTHING IN THESE TERMS LIMITS OR EXCLUDES OUR LIABILITY FOR PROFESSIONAL NEGLIGENCE IN THE DELIVERY OF CLINICAL CARE, NOR DOES IT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
SUBJECT TO THE PRECEDING SENTENCE, TO THE FULLEST EXTENT PERMITTED BY LAW, (A) NEITHER WE NOR OUR OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE; AND (B) OUR TOTAL CUMULATIVE LIABILITY ARISING FROM YOUR USE OF THE SITE (AS OPPOSED TO CLINICAL CARE) WILL NOT EXCEED THE GREATER OF (I) THE TOTAL FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (II) FIVE HUNDRED U.S. DOLLARS ($500.00). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest amount permitted by law.
18. Indemnification
You agree to defend, indemnify, and hold harmless the Practice and its owners, employees, and agents from and against any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your misuse of the Site, (b) your breach of these Terms, or (c) your violation of law or of the rights of any third party. This provision does not apply to claims arising from our clinical care of you, which are governed by applicable medical-malpractice and professional-liability law.
19. Governing Law & Dispute Resolution
These Terms and any dispute arising out of your use of the Site are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles. Clinical claims are separately governed by the medical-liability and licensing law of the state where the care was delivered. For disputes about the Site or these Terms (as opposed to clinical care), you and we agree first to attempt in good faith to resolve the dispute by direct discussion for thirty (30) days. If the dispute is not resolved, either party may file suit in a state or federal court located in Sarpy County, Nebraska, and both parties consent to personal jurisdiction there.
Nothing in this section limits any right you have to file a complaint with a state medical or nursing board, a state attorney general, the U.S. Department of Health and Human Services Office for Civil Rights, or any other government regulator.
20. Changes to these Terms
We may update these Terms from time to time. The "Last Updated" date at the top shows when the current version took effect. Material changes will be posted on this page for a reasonable period. If you continue to use the Site after a change, you agree to the updated Terms.
21. General Provisions
- Entire agreement. These Terms, the Privacy Policy, and any clinical-consent documents you sign together form the entire agreement between you and us regarding the subject matter and supersede any prior agreements.
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, sale, or other corporate transaction.
- No third-party beneficiaries. These Terms do not create rights in any third party.
- Electronic communications. By using the Site or booking with us, you consent to receive communications from us electronically (for example, by email or through the patient portal) and agree that such communications satisfy any legal requirement that communications be in writing.
- Force majeure. We are not liable for delays, interruptions, or failures caused by circumstances beyond our reasonable control, including (without limitation) technology outages, vendor failures, natural disasters, severe weather, fires, power or telecommunications failures, labor disputes, acts of civil or military authority, and public-health emergencies. We will use reasonable efforts to minimize the impact of any such event on your care.
22. SMS, Text & Automated Communications (TCPA)
If we communicate with you by SMS or automated calls (for example, appointment reminders, refill notices, or lab-result alerts), we comply with the Telephone Consumer Protection Act (47 U.S.C. § 227), Federal Communications Commission implementing rules (effective January 27, 2025), and applicable state telemarketing and do-not-call laws.
- Consent at intake. You will be given the opportunity to provide express written consent to receive SMS or automated voice messages at intake. You may receive healthcare-related text messages only after you have opted in, and you may opt out at any time.
- Message types. If you opt in, messages may include appointment reminders, scheduling confirmations, refill and pharmacy alerts, lab-result notifications, billing notices, and other care-related messages. We do not send marketing or promotional SMS.
- Frequency and rates. Message frequency varies based on your care. Message and data rates may apply, depending on your mobile carrier and plan.
- Opt out. You can stop text messages at any time by replying STOP to any message from us. For help, reply HELP. Opting out of SMS does not affect your ability to receive care by other channels (phone, portal, email).
- Privacy. SMS is not fully secure. We will not include clinical detail in SMS beyond what is necessary (for example, appointment date and time). For anything clinically sensitive, we will use the patient portal.
